TERMS OF SERVICE
1. General
1.1. These general terms and conditions apply to every offer from Soigné Pro and to every agreement concluded between Soigné Pro and the consumer. The terms and conditions are accessible to everyone and are included on the Soigné Pro website. Upon request, we will send you a written copy.
1.2. By placing an order, you indicate that you agree to the delivery and payment conditions. Soigné Pro reserves the right to change its delivery and/or payment conditions after the expiration of the term.
1.3. Unless otherwise agreed in writing, Soigné Pro does not recognize the general or specific terms or conditions of third parties.
1.4. Soigné Pro guarantees that the delivered product meets the agreement and complies with the specifications stated in the offer.
2. Delivery
2.1. Delivery takes place while supplies last.
2.2. In the context of the rules of distance selling, Soigné Pro will execute orders within 30 days at least, unless another delivery period has been agreed. If delivery within 30 days or another agreed delivery time is not possible (due to the ordered item not being in stock or no longer available), or there is a delay for other reasons, or an order cannot be executed, or only partially, the consumer will receive notification within 1 month after placing the order and in that case, has the right to cancel the order without costs and without notice of default.
2.3. Soigné Pro's delivery obligation, unless proven otherwise, is fulfilled once the goods delivered by Soigné Pro have been offered to the consumer once. In the case of home delivery, the carrier's report, indicating the refusal of acceptance, constitutes full proof of the offer for delivery.
2.4. All terms mentioned on the website are indicative. Therefore, no rights can be derived from the mentioned terms.
3. Prices
3.1. Prices will not be increased during the validity period of the offer, unless legal measures make this necessary or if the manufacturer implements interim price increases.
3.2. All prices on the site are subject to printing and typing errors. No liability is accepted for the consequences of printing and typing errors.
3.3. All prices on the site are in Euros and include 21% VAT.
4. Reflection period / right of withdrawal
4.1. If there is a consumer purchase, in accordance with the Distance Selling Act (Article 7:5 BW), the consumer has the right to return (part of) the delivered goods within a period of 14 working days without giving any reason. This period starts on the day the ordered items are delivered. The consumer is obliged, before proceeding to return, to notify Soigné Pro of this within the 14-day period after receipt. If the consumer has not reported the use of the statutory right of withdrawal within the 14-day reflection period after receipt, the purchase is final.
During the reflection period, the consumer will handle the product and packaging with care. He will only unpack or use the product to the extent necessary to assess the nature, characteristics, and functioning of the product. If he exercises his right of withdrawal, he will return the product to the entrepreneur within 28 days after receipt, in accordance with the reasonable and clear instructions provided by the entrepreneur.
The consumer must prove that the delivered goods have been returned on time, for example by means of proof of postage. Return of the goods must be done in the original packaging (including accessories and accompanying documentation) and in new condition. If the goods have been used, encumbered or damaged in any way by the consumer, Soigné Pro reserves the right to charge depreciation. Subject to what is stipulated in the preceding sentence, Soigné Pro will refund within 14 days after receipt of the returned goods or within 14 days after proof of return (the contents of the return shipment must be explicitly stated on the proof of shipment), the amount paid. In the case of a return of the entire purchase, the full purchase amount including any calculated shipping and/or payment costs will be refunded to the consumer. In the case of a return of only part of the received purchases, only the purchase value of the returned goods will be refunded. Additional costs resulting from a more expensive method of shipping than the cheapest standard delivery will never be refunded.
The return of the delivered goods is entirely at the expense and risk of the consumer.
4.2. The right of withdrawal does not apply to:
- service agreements, after full performance of the service, and only if the performance has begun with the explicit prior consent of the consumer and the consumer has declared that he loses his right of withdrawal as soon as the entrepreneur has fully performed the agreement;
- goods or services whose price is dependent on fluctuations in the financial market over which the supplier has no influence and which may occur within the withdrawal period;
- goods that are manufactured according to the consumer's specifications, for example, custom-made products, or that have a clearly personal character;
- products with a limited shelf life that have expired within the 14-day reflection period (perishable goods);
- sealed products that are not suitable for return for reasons of health protection or hygiene and whose seal has been broken after delivery;
- Cosmetics products that have been opened;
- for goods or services that, by their nature, cannot be returned, for example, due to hygiene reasons or that can spoil or age quickly.
5. Data management
5.1. If you place an order with Soigné Pro, your data will be included in the Soigné Pro customer file. Soigné Pro complies with the Personal Data Protection Act and will not disclose your data to third parties. See our Privacy Policy.
5.2. Soigné Pro respects the privacy of the users of the website and ensures confidential treatment of your personal data.
5.3. In some cases, Soigné Pro uses a mailing list. Each mailing contains instructions on how to remove yourself from this list.
6. Warranty and conformity
6.1. The entrepreneur guarantees that the products and/or services comply with the agreement, the specifications stated in the offer, meet the reasonable requirements of soundness and/or usability and the existing legal provisions and/or government regulations on the date of the conclusion of the agreement.
6.2. A warranty offered by the entrepreneur, manufacturer, or importer does not affect the legal rights and claims that the consumer can assert against the entrepreneur based on the contract.
6.3. If it appears that the delivered item is incorrect, defective, or incomplete, the consumer must report these defects to Soigné Pro in writing within 2 months after discovery of the defect, before returning it to Soigné Pro. The return of the goods must be done in the original packaging (including accessories and accompanying documentation). Use after the discovery of defects, damage caused after the discovery of defects, burdening, and/or resale after the discovery of defects, renders the right to complain and return null and void.
6.4. If complaints from the consumer are found to be justified by Soigné Pro, Soigné Pro will repair or replace the delivered goods at the choice of the consumer free of charge. Any liability of Soigné Pro for damage is limited to a maximum of the invoice amount of the goods concerned, or (at the choice of Soigné Pro) to the maximum amount covered by the liability insurance of Soigné Pro in the relevant case.
Any liability of Soigné Pro for any other form of damage is excluded, including supplementary compensation in any form whatsoever, compensation for indirect damage or consequential damage, or damage due to loss of profit.
6.5. Soigné Pro is not liable for damage caused by intent or gross negligence similar to intent by non-managerial staff.
6.6. This warranty does not apply if: A) and as long as the consumer is in default towards Soigné Pro; B) the consumer has repaired the delivered goods himself and/or has had them repaired or processed by third parties. C) the delivered goods have been exposed to abnormal conditions or otherwise treated carelessly or contrary to the instructions of Soigné Pro and/or the instructions for use on the packaging;
7. Offers
7.1. Offers are without obligation, unless otherwise stated in the offer.
7.2. When accepting a non-binding offer from the buyer, Soigné Pro reserves the right to revoke or deviate from the offer within the period of 3 working days after receipt of that acceptance.
7.3. Oral promises only bind Soigné Pro after they have been expressly confirmed in writing.
7.4. Offers from Soigné Pro do not automatically apply to repeat orders.
7.5. Soigné Pro cannot be held to its offer if the consumer should have understood that the offer, or any part thereof, contained an obvious mistake or error in writing.
7.6. Additions, changes, and/or further agreements are only effective if agreed in writing.
7.7. Products purchased for offers thereof, the price difference will not be refunded.
8. Agreement
8.1. An agreement between Soigné Pro and a customer is established after an order has been assessed for feasibility by Soigné Pro.
8.2. Soigné Pro reserves the right to refuse orders or commissions without stating reasons or to accept them only on the condition that shipment takes place under cash on delivery or after prepayment.
9. Images and specifications
9.1. All images; photos, drawings, etc.; including data regarding weights, dimensions, colors, images of labels, etc. on the Soigné Pro website are approximate, indicative, and cannot be a reason for compensation or dissolution of the agreement.
10. Force Majeure
10.1. Soigné Pro is not liable if and insofar as its obligations cannot be fulfilled due to force majeure.
10.2. Force majeure is understood to mean any foreign cause, as well as any circumstance that, in all reasonableness, should not be at its risk. Delays or non-performance by our suppliers, disruptions in the Internet, disruptions in electricity, disruptions in e-mail traffic, and disruptions or changes in technology supplied by third parties, transportation difficulties, strikes, government measures, delays in supply, negligence by suppliers and/or manufacturers of Soigné Pro as well as of auxiliary persons, illness of personnel, defects in auxiliary or transport equipment are expressly considered force majeure.
10.3. In the event of force majeure, Soigné Pro reserves the right to suspend its obligations and is also entitled to terminate the agreement in whole or in part, or to demand that the content of the agreement be changed in such a way that execution remains possible. In no case is Soigné Pro obliged to pay any fine or compensation.
10.4. If Soigné Pro has already partially fulfilled its obligations at the time of force majeure, or can only partially fulfill its obligations, it is entitled to separately invoice the already delivered or deliverable part and the customer is obliged to pay this invoice as if it were a separate contract. However, this does not apply if the already delivered or deliverable part has no independent value.
11. Liability
11.1. Soigné Pro is not liable for damage caused to vehicles or other objects as a result of improper use of the products. Please read the instructions on the packaging and/or consult our website before use.
12. Applicable law/competent court
12.1. Belgian law applies to all agreements.
12.2. The competent court within the Antwerp district will have jurisdiction to hear any disputes arising from an agreement between Soigné Pro and the buyer, which cannot be resolved by mutual agreement, unless Soigné Pro prefers to submit the difference to the competent court of the buyer's place of residence, and with the exception of disputes that fall within the jurisdiction of the district court.
